The Current Political Climate Impacts to the LGBTQ+ Community in Real Estate
Right now, we are all bracing for impact as the new administration comes to power. Project 2025 is pretty clear about how it wants to strip access to care for Trans youth and eventually dismantle same sex marriage. Never mind the fact that many of us still do not have protections in various states.

We are talking to different organizations to help insulate our clients as much as possible. At the same time, we do know that we will all be impacted eventually.

LGBTQ+ homebuyers and sellers often face unique challenges. Many states do not have Fair Housing laws protecting LGBTQ+ folks. Biden added protections at the Federal level through an Executive Order. We all know what is going to happen to those protections.
Hence having an LGBTQ+ agent will help you and your household navigate the real estate process. First off, using appropriate pronouns for many of us is the baseline. It is not an exception! An informed real estate agent will be able to assist you with how to take title, deal with bratty agents, and give you information about local community resources.
Working With an LGBTQ+ Agent Means You Are in a Safe and Inclusive Space
Our office on Capitol Hill is in the heart of the Gayborhood. We have non-gendered bathrooms and strict guidelines on how people should be treated in our space. Most LGBTQ+ real estate agents choose offices that provide them with support that is judgment-free. Home buyers and sellers make their best decisions when they are in an environment that is safe and inclusive.
No one enjoys having to deal with someone else’s prejudices and micro-aggressions.
Advocacy in Action
I want to take a second to chat about my own LGBTQ+ advocacy background. Our LGBTQ+ Seattle home buyers and sellers have benefited from our long standing advocacy as LGBTQ+ real estate agents. I have been an “OUT” lesbian since the late 1980s. Through the 1980s and 1990s I worked in politics helping to pass protections for LGBTQ+ folks. I have also worked on passing pro-choice legislation, and being an HIV/AIDS community advocate. In 1999 I went into real estate with the belief that people should have someone with my unique skill set being their advocate.
Over the years, my wife Chavi and I have used our real estate platform to help pass Marriage Equality in our state and advocate for Queer youth. We’ve also gone up against the REALTORs to advocate for education funding. In other words, I know a thing or two about being an informed LGBTQ+ real estate agent.
There is nothing we will not do to make sure our clients are given the best options to live their gayest lives!!!
Navigating How to Take Title To Ensure Your Rights Are Protected
A well-informed LGBTQ+ real estate agent will be able to help you navigate how to take title on your home to make sure you have rights of survivorship. Currently, we are closely monitoring what will happen with same sex marriage. Right now the law gives many of us married queers protections in the areas of inheritance. There are cases being sampled in places like Tennessee which gives people the right to refuse to perform same sex marriages. Our concern is that this will be extended to rights of survivorship. We are also concerned this could also potentially be a Supreme Court Case overturning marriage equality.
Tenants in Common With the Rights of Survivorship
An informed real estate agent should also help you make sure that the title to your house is taken as follows: “Tenants in Common with the Rights of Survivorship.” This might need to be put into the purchase and sale contract or it can be a conversation with the Title/Escrow company.
